Arbitration is a private means of dispute resolution whereby parties agree to be bound by the decision of an arbitrator of their choice whose decision is final and whose award has the legal force of a High Court judgment or order. Arbitration is a widely used alternative to litigation before the Courts. The use of arbitration is on the increase, and new legislation, the Arbitration Act, 2010, was introduced in 2010 to make Ireland a world leader in the field of arbitration. The principal advantages of arbitration over other forms of dispute resolution are privacy; flexibility of procedure; the ability to use arbitrators who are experts in the field of dispute; cost-effectiveness; and enforceability of the award both domestically and internationally. This micro-credential focuses on the law and practice of domestic arbitration. It covers the arbitration agreement, the arbitrator, the arbitral process, the award, recourse against the award, and enforcement of the award. On completion of this micro-credential you will have completed the syllabus of the Chartered Institute of Arbitrators' Module 2 Law of Arbitration and the written components of the Institute's Module 3: Practice, Procedure, Drafting and Deciding.

This micro-credential focuses on the skills required to write an arbitrator's award which is precise, reasoned, valid and enforceable, ethical, and which follows good practice in decision making and in structuring and expressing decisions and determinations. Though its main focus is Arbitration, the skills developed in the micro-credential may also be of relevance in other walks of decision-making including construction adjudication, commercial adjudication, expert determination, disciplinary tribunals and investigation, sports adjudication, and other contexts in which judgment must be exercised and determination delivered. This micro-credential facilitates participants develop the knowledge and skills that underpin the mediation of conflicts and disputes. In addition to understanding current concepts, policy and good practice relating to mediation, participants will develop the critical skills required to be an effective mediator.
